If your immigration application has been unjustly refused, you may be able to challenge the decision through either an administrative review or an immigration appeal, depending on the type of application and grounds for refusal.
Administrative Review
An administrative review is submitted to the Home Office and is used to challenge errors in the decision-making process. This route is generally available where there is no right of appeal. For decisions under the EU Settlement Scheme, administrative review may be available alongside or instead of the right of appeal.
Right of Appeal
The right of appeal is limited to certain application types—typically those involving Human Rights grounds, such as applications made by a spouse or partner of a British citizen or adult dependent relatives. This right is not available for most work-related immigration routes.
Immigration appeals are heard by an independent Immigration Tribunal, not the Home Office. Cases are decided by an Immigration Judge, and hearings may take place either on paper or in person—either in court or via video link. These proceedings usually involve witnesses, witness statements, and document bundles prepared by both parties.
